These Terms of Service ("Terms") govern your use of EZTracker Air, an aircraft maintenance management system provided by EZ Tracker, LLC ("Company", "we", "us", or "our"). By accessing or using EZTracker Air, you ("User", "you", or "your") agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using EZTracker Air, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you may not use EZTracker Air.

2. Description of Service

EZTracker Air is a digital aircraft maintenance tracking and management tool designed to help aircraft owners and operators organize maintenance schedules, track inspections, and manage flight records. The service includes features such as:

• Maintenance item tracking and scheduling

• Flight record management

• AI-powered document analysis (AutoLog)

• AI assistant for general aviation information

• Reporting and compliance tools

 

3. User Responsibilities and Limitations

CRITICAL DISCLAIMER:

 

NOT AN OFFICIAL LOGBOOK: EZTracker Air is NOT intended to replace official aircraft maintenance logbooks, records, or documentation required by the Federal Aviation Administration (FAA) or other regulatory authorities. You must maintain proper official records in compliance with 14 CFR Parts 43, 91, and other applicable regulations.

 

DATA ACCURACY: You are solely responsible for the accuracy, completeness, and validity of all information entered into EZTracker Air. The Company makes no warranties about the accuracy of user-entered data or AI-generated content.

 

AI VERIFICATION REQUIRED: All AI AutoLog extractions and AI assistant responses must be independently verified by qualified personnel. AI technology may contain errors, misinterpretations, or inaccuracies that could affect aircraft safety or regulatory compliance.

 

PROFESSIONAL CONSULTATION: EZTracker Air and its AI features do not constitute professional aviation maintenance advice. Always consult with certificated A&P mechanics, Inspection Authorized (IA) personnel, or other qualified aviation maintenance professionals for maintenance decisions and regulatory compliance matters.

 

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of EZTracker Air

• The Company makes no warranties, express or implied, regarding the accuracy, reliability, or fitness for any particular purpose of EZTracker Air

• You assume all risks associated with the use of EZTracker Air and any decisions made based on information provided by the service

• The Company's total liability to you shall not exceed the amount paid for your EZTracker Air subscription

 

5. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to your use of EZTracker Air, your violation of these Terms, or your violation of any rights of another party.

 

6. Data Privacy and Security

We take reasonable measures to protect your data, but you acknowledge that no system is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for backing up your important data.

We may use aggregated, anonymized data for service improvement purposes. We will not share your personal aircraft information with third parties without your consent, except as required by law.

Partner Data Sharing Consent

By using EZTracker Air, you acknowledge and consent that when you request any of the following services, your relevant personal and aircraft information may be shared with our trusted service partners in order to fulfill your request:

• Aircraft Valuation & Brokerage: When you use the Aircraft Valuation feature or request brokerage services, your aircraft information, valuation results, contact details, and uploaded photos may be shared with AGL Flight, LLC and affiliated brokerage partners.

• Aircraft Insurance Quotes: When you request an insurance quote, your aircraft details and contact information may be shared with our insurance partner(s) to provide you with a quote.

• Flight Training & Education Services: When you request information about flight training or education services, your contact information and relevant pilot details may be shared with our flight training partners.

• Aircraft Paint & Interior Quotes: When you submit a request for a paint or interior quote, your aircraft information, photos, and contact details may be shared with our paint and interior service partners.

Partner information sharing is limited to what is necessary to fulfill your specific service request and will not be used for unrelated marketing purposes without your additional consent.

 

7. Subscription and Billing

EZTracker Air operates on a subscription basis. Fees are charged in advance and are non-refundable except as required by law or as expressly stated in these

Terms.

 

You may cancel your subscription at any time, and the cancellation will take effect at the end of your current billing period.

 

Refund Policy:

Trial Period Cancellations: If you cancel your subscription during the trial period (before the trial ends), your credit or debit card will not be charged, and you will not be billed for the subscription.

Post-Trial Cancellations: If you cancel after your trial period has ended and your payment method has been charged, your subscription will remain active until the end of your current billing period. Your account will then close on your subscription renewal date. No refunds will be issued for the current billing period or any prior billing periods.

 

No Partial Refunds: Subscription fees are non-refundable, and we do not provide refunds or credits for partial months of service or unused features.

 

8. Referral Program

EZTracker Air offers a referral program that allows users to earn free months of service by referring new paid subscribers to the platform.

 

Program Details:

• Earning Credits: For every successful referral that results in a paid subscription, the referring user earns 1 free month of EZTracker Air service.

• Application Timeline: Referral credits are applied within 5 business days after the referred user subscribes to a paid plan and maintains that subscription for 30 days.

• Annual Subscribers: Credits extend the subscription period by 30 days (1/12 of a year) per earned credit.

• Maximum Referrals: Each user may earn credits for a maximum of 3 successful referrals (3 free months total).

• Validation Period: If a referred user cancels their paid subscription or downgrades to a free plan within the first 30 days of their subscription, the referring user will not receive credit for that referral.

 

Program Rules and Restrictions:

• Referral codes are unique to each user and non-transferable.

• Self-referrals are prohibited and will not be credited.

• Users may not create multiple accounts to abuse the referral program.

• Sub-account additions do not count as referrals for the referral program.

• The Company reserves the right to investigate and invalidate any suspicious referral activity.

• Referral credits have no cash value and cannot be transferred or redeemed for cash.

• The Company may modify or terminate the referral program at any time with reasonable notice.

• Any abuse or gaming of the referral system may result in account termination.

 

9. Third-Party Services and Infrastructure

EZTracker Air utilizes industry-standard, enterprise-grade third-party cloud infrastructure and data management services to store, process, and deliver application functionality. These services are selected for their robust security measures, reliability, and performance capabilities.

 

Service Availability and Limitations:

• Our third-party service providers maintain industry-leading uptime standards, typically 99.9% or higher.

• However, EZ Tracker, LLC has no direct control over the uptime, availability, or performance of these third-party infrastructure services.

• In the event of a service outage, data breach, or other incident affecting third-party services, we will work cooperatively with our service providers to restore functionality and protect your data as quickly as possible.

• We will make reasonable efforts to notify affected users of any significant service disruptions or security incidents in a timely manner.

 

Limitation of Liability for Third-Party Services: To the maximum extent permitted by law, EZ Tracker, LLC shall not be held liable for any damages, losses, or service interruptions resulting from the failure, unavailability, security breach, or malfunction of third-party infrastructure or services. This includes, but is not limited to, data loss, service downtime, unauthorized access, or any other issues arising from third-party service providers.

 

By using EZTracker Air, you acknowledge and accept that our service depends on third-party infrastructure and that such dependencies may occasionally result in service interruptions or performance issues beyond our control.

 

10. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access to EZTracker Air. We may perform maintenance, updates, or modifications that may temporarily affect service availability. We are not liable for any downtime or service interruptions, whether caused by our systems or third-party infrastructure.

 

11. Installation of Components on Your Device

To provide a fully functional application experience, EZTracker Air may install certain software components, libraries, or services on your device, including but not limited to service workers, caches, and other technical components necessary for offline functionality, performance optimization, and push notification support.

 

About Installed Components:

• These components are essential for EZTracker Air to function properly and may be installed automatically when you first access the application.

• Service workers and related technologies enable offline access, faster load times, and push notifications.

• You may manage these installed components through your browser or device settings at any time.

• Removing these components may limit certain functionality of EZTracker Air, such as offline access or push notifications.

 

By using EZTracker Air, you acknowledge and consent to the installation of these necessary technical components on your device.

 

12. Geographic Restrictions — United States Only

IMPORTANT: SERVICE RESTRICTED TO UNITED STATES RESIDENTS AND USERS

 

EZTracker Air is intended solely for use by individuals and entities located within the United States of America. Access to or use of EZTracker Air from outside the United States is strictly prohibited. By accessing or using EZTracker Air, you represent and warrant that you are physically located within the United States at the time of use and that you are a resident or legal entity domiciled in the United States.

Prohibition on International Use: EZTracker Air makes no representation that the service is appropriate, available, or legal in any location outside the United States. Access to the service from territories where its content or use is illegal is strictly prohibited. The Company expressly disclaims any responsibility or liability for any access or use of the service outside the United States.

 

No Foreign Law Compliance: EZTracker Air is designed and operated in compliance with the laws of the United States only. The Company does not represent or warrant compliance with the laws, regulations, directives, or requirements of any foreign jurisdiction, including but not limited to the European Union General Data Protection Regulation (GDPR), the United Kingdom Data Protection Act, Canadian privacy laws (PIPEDA), or any other international, national, or local laws outside the United States. You assume all risk and responsibility for any legal obligations arising from your use of the service outside the United States.

Indemnification for Unauthorized International Use: If you access or use EZTracker Air from outside the United States in violation of these Terms, you agree to indemnify, defend, and hold harmless the Company from and against any and all claims, penalties, fines, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of any applicable foreign laws, regulations, or directives resulting from such unauthorized use.

 

Right to Restrict Access: The Company reserves the right, at its sole discretion and without prior notice, to restrict, suspend, or terminate access to EZTracker Air for any user or entity that the Company reasonably believes is accessing the service from outside the United States or is otherwise in violation of this geographic restriction. No refund or credit will be issued in connection with any such restriction, suspension, or termination.

 

13. Prohibited Uses

You agree not to use EZTracker Air to:

• Violate any applicable laws or regulations

• Interfere with the operation of the service

• Attempt to gain unauthorized access to the system

• Share your account credentials with unauthorized users

• Use the service for any illegal or harmful activities

 

14. Intellectual Property

EZTracker Air and all related software, content, and materials are the intellectual property of EZ Tracker, LLC. You are granted a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms.

 

15. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason we deem appropriate. You may terminate your account at any time by contacting us.

EZTracker Air may terminate accounts in the course of its business and/or elect to discontinue service. In this event, EZTracker Air will notify customers no less than 30 days in advance. Users will be provided the opportunity to download a copy of the raw data they inputted into the EZTracker Air app with the exception of any images or documents uploaded. Users will also be allowed to export any and all reports associated with the user's account prior to the termination date.

Upon termination, your right to use EZTracker Air ceases immediately, and we may delete your data after a reasonable period.

 

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

 

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the service. Your continued use of EZTracker Air after such modifications constitutes your acceptance of the updated Terms.

 

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

 

19. SMS Notifications

EZTracker Air offers optional SMS notifications to help you stay informed about important aircraft maintenance alerts, flight reminders, and other service updates.

 

SMS Opt-In & Consent

By providing your mobile phone number and enabling SMS notifications in your profile settings, you expressly consent to receive automated text messages from EZTracker Air at the phone number provided. Consent is not a condition of purchase or use of our services.

Message Frequency: Varies based on your preferences. May include daily, weekly, or monthly flight reminders, plus maintenance alerts and squawk updates as they occur.

 

Message & Data Rates: Standard text messaging rates from your wireless carrier may apply.

Opt-Out: Reply STOP to any message to unsubscribe, or disable SMS in Profile Settings.

Help: Reply HELP to any message or contact contact@eztrackerair.com for assistance.

Privacy: Your phone number will only be used for the notifications you've opted into and will not be shared with third parties for marketing purposes.

Automated Messages: By opting in, you consent to receive automated text messages. SMS notifications are supported for most major U.S. wireless carriers. Delivery to certain carriers or regions may not be available. EZTracker Air reserves the right to modify or discontinue SMS notifications at any time with reasonable notice.
